These terms apply solely between the legal person VINCENZO JUNIOR ADAMO, with registered office at via XXVII Maggio, 11 \u2013 91026 \u2013 Mazara del Vallo (TP), Italy, VAT no. 02716090812, hereinafter referred to as \u201dBLACK SQUIRREL PARACORD\u201d, and any person making purchases online on the website www.blacksquirrelparacord.com, hereinafter referred to as the \u201dCUSTOMER\u201d. These terms may be amended, and the date on which they are published on the site is the date they come into force.<\/span><\/p>\n

These terms govern purchases made on the site www.blacksquirrelparacord.com, in accordance with Part III, Title III, Chapter I of the Italian Consumer Code, Legislative Decree no. 206\/2005, as amended by Legislative Decree no. 21\/2014 and by Legislative Decree 70\/2003 on electronic commerce.<\/p>\n

Under these general terms of sale, BLACKSQUIRREL PARACORD sells and the CUSTOMER purchases at a distance the tangible movable goods listed and offered for sale on the site www.blacksquirrelparacord.com. The contract is concluded exclusively over the internet, through the CUSTOMER accessing www.blacksquirrelparacord.com and placing a purchase order following the procedure set out on the site.<\/span><\/p>\n

Before confirming their order, the customer undertakes to read these general terms of sale, and in particular the pre-contractual information provided by BLACK SQUIRREL PARACORD, and to accept them by ticking the box indicated.<\/p>\n

In the order confirmation email, the CUSTOMER will also receive a link to download and store a copy of these general terms of sale, as required by art. 51 paragraph 1 of Legislative Decree 206\/2005, as amended by Legislative Decree 21\/2014.<\/p>\n

Before the purchase contract is concluded, the CUSTOMER reviews the characteristics of the goods, which are set out on the individual product pages at the time the CUSTOMER makes their choice.<\/span><\/p>\n

Before confirming the order with an \u201cobligation to pay\u201d, the CUSTOMER is informed of:
\u2013 the total price of the goods including taxes, with a breakdown of shipping costs and any other charges;
\u2013 payment methods;
\u2013 the deadline by which BLACK SQUIRREL PARACORD undertakes to deliver the goods;
\u2013 the conditions, time limits and procedures for exercising the right of withdrawal (art. 6 of these terms) as well as the model withdrawal form set out in Annex I, part B of Legislative Decree 21\/2014;
\u2013 notice that the CUSTOMER will bear the cost of returning the goods in the event of withdrawal;
\u2013 the existence of the legal guarantee of conformity for the goods purchased; \u2013 the after-sales support conditions and commercial warranties offered by BLACK SQUIRREL PARACORD.<\/p>\n

The CUSTOMER may at any time, and in any case before the contract is concluded, review the information concerning BLACK SQUIRREL PARACORD, its physical address, telephone number and email address, which is also set out below:<\/p>\n

ARTICLE 3 – CONCLUSION AND EFFECT OF THE CONTRACT<\/b><\/div>\n<\/div>\n<\/div>\n

The sales contract is deemed concluded when BLACK SQUIRREL PARACORD sends the CUSTOMER an order confirmation email. The email contains the CUSTOMER’s details and the order number, the price of the goods purchased, the shipping costs, the delivery address to which the goods will be sent, and the link to print and store a copy of these terms.<\/span><\/p>\n

The CUSTOMER undertakes to check that the personal details in the above email are correct and to notify BLACK SQUIRREL PARACORD promptly of any corrections or changes needed.<\/p>\n

BLACK SQUIRREL PARACORD undertakes to describe and present the items sold on the site as accurately as possible. Even so, there may be errors, inaccuracies or small differences between the product shown on the site and the actual product. Furthermore, the photographs of the products shown on www.blacksquirrelparacord.com do not form part of the contract, as they are to be considered indicative only.<\/p>\n

BLACK SQUIRREL PARACORD undertakes to deliver the goods within 15 days of sending the order confirmation email to the CUSTOMER.<\/p>\n

ARTICLE 4 – PRODUCT AVAILABILITY<\/b><\/div>\n<\/div>\n<\/div>\n

Product availability refers to actual availability at the moment the CUSTOMER places the order. That availability should nevertheless be treated as indicative only, because:<\/span><\/p>\n

\u2013 products may be sold to other CUSTOMERS before the order is confirmed, because several users are on the site at the same time,<\/p>\n

\u2013 a technical fault may make a product available for purchase when in fact it is not.<\/p>\n

Even after BLACK SQUIRREL PARACORD has sent the order confirmation email, the goods may turn out to be partly or wholly unavailable. In that case the order will be adjusted automatically, removing the unavailable product or products, and the CUSTOMER will be informed immediately by email; that email will also tell the customer how and when any sums already paid will be refunded.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

ARTICLE 5 – PAYMENT METHODS<\/b><\/div>\n<\/div>\n<\/div>\n

Any payment by the CUSTOMER may only be made using the credit cards listed on the site www.blacksquirrelparacord.com, by bank transfer or via Paypal.<\/span><\/p>\n

Where payment is made by Paypal, the charge is actually taken when BLACK SQUIRREL PARACORD sends the order confirmation email.<\/p>\n

Payment communications and the data provided by the CUSTOMER at the time of payment take place over dedicated secure connections. The security of credit card payments is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

ARTICLE 6 – PRICES<\/b><\/div>\n<\/div>\n<\/div>\n

All product sale prices shown on the site www.blacksquirrelparacord.com are in Euros and include VAT.<\/span><\/p>\n

Shipping costs are not included in the purchase price, but are shown and calculated at the end of the purchase process, before payment is made.<\/p>\n

The CUSTOMER accepts that BLACK SQUIRREL PARACORD may change its prices at any time; however, the goods will be invoiced at the prices shown on the site at the time the order was created and stated in the confirmation email sent by BLACK SQUIRREL PARACORD to the CUSTOMER.<\/p>\n

In the event of a computer, manual, technical or any other kind of error causing a substantial change to the retail price not intended by BLACK SQUIRREL PARACORD, making it exorbitant or clearly negligible, the purchase order will be considered invalid and cancelled, and the amount paid by the CUSTOMER will be refunded within 14 days of the date of cancellation.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

ARTICLE 7 – RIGHT OF WITHDRAWAL<\/b><\/div>\n<\/div>\n<\/div>\n

\n

In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without penalty and without giving a reason, within 14 days of the date the products are received.<\/span><\/p>\n

A CUSTOMER wishing to exercise the right of withdrawal must notify BLACK SQUIRREL PARACORD by explicit statement, which may be sent by email or made by telephone.<\/p>\n

Where the right of withdrawal is exercised, the CUSTOMER must return the goods within 14 days of the day they notified BLACK SQUIRREL PARACORD of their intention to withdraw from the contract, pursuant to art. 57 of Legislative Decree 206\/2005.<\/p>\n

The goods must be returned to Black Squirrel Paracord di Vincenzo Adamo, via XXVII Maggio, 11 \u2013 91026 \u2013 Mazara del Vallo (TP), Italy<\/p>\n

The goods must be returned undamaged, in their original packaging, complete in all their parts (including packaging and any documentation and accessories: manuals, cables, etc.) and together with any tax documentation enclosed. Subject to its right to verify compliance with the above, BLACK SQUIRREL PARACORD will refund the amount of the products covered by the withdrawal within a maximum of 14 days.<\/p>\n

As regards the return of the product covered by the withdrawal, all shipping costs will be borne by the CUSTOMER (art. 56 para. 2 of Legislative Decree 206\/2005).<\/p>\n

As provided by art. 56 paragraph 3 of Legislative Decree 206\/2005, as amended by Legislative Decree 21\/2014, BLACK SQUIRREL PARACORD may withhold the refund until it has received the goods or until the CUSTOMER has shown evidence of having sent them back to BLACK SQUIRREL PARACORD.<\/p>\n

BLACK SQUIRREL PARACORD will issue the refund using the same payment method chosen by the CUSTOMER at the time of purchase. Where payment was made by bank transfer, a CUSTOMER wishing to exercise their right of withdrawal must provide BLACK SQUIRREL PARACORD, via the contact us section, with their bank details: the IBAN, SWIFT and BIC needed for BLACK SQUIRREL PARACORD to make the refund.<\/p>\n

*It is understood that where the product is faulty or BLACK SQUIRREL PARACORD has made a mistake (for example: model, colour, size), the shipping costs will in all cases be borne by BLACK SQUIRREL PARACORD.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

ARTICLE 8 – LEGAL GUARANTEE OF CONFORMITY<\/b><\/div>\n<\/div>\n<\/div>\n

If the products received are faulty or otherwise not as ordered, the CUSTOMER has the right to have the product brought back into conformity free of charge, by repair or replacement. The CUSTOMER may exercise this right if the fault appears within two years of delivery of the goods and they report the fault to BLACKSQUIRREL PARACORD within two months of discovering it. To exercise the above right, the customer must notify BLACK SQUIRREL PARACORD by email or telephone. Where a product is faulty or not as ordered, BLACK SQUIRREL PARACORD will arrange collection of the product at its own expense, subject to the CUSTOMER’s availability.<\/span><\/p>\n

ARTICLE 9 – COMMERCIAL WARRANTY<\/b><\/div>\n<\/div>\n<\/div>\n

In addition to the legal guarantee of conformity described in the previous article, all products shown on the site www.blacksquirrelparacord.com carry a two-year commercial warranty.<\/span><\/p>\n

To obtain warranty support, the CUSTOMER must keep the invoice or a copy of the purchase confirmation email.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

ARTICLE 10 – DELIVERY<\/b><\/div>\n<\/div>\n<\/div>\n

BLACK SQUIRREL PARACORD accepts orders for delivery to countries in the European Union: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden. We do not ship to countries outside the European Union, including the United Kingdom and Switzerland. Products will be delivered by GLS express courier to the address given by the CUSTOMER when ordering, within no more than 15 days of the date the CUSTOMER receives the order confirmation email sent by BLACK SQUIRREL PARACORD.<\/span><\/p>\n

ARTICLE 11 – LIABILITY<\/b><\/div>\n<\/div>\n<\/div>\n

BLACK SQUIRREL PARACORD accepts no liability for disruption caused by force majeure or unforeseeable events, including any arising from malfunctions or outages of the internet, where it is unable to fulfil the order within the time frame set out in the contract.<\/span><\/p>\n

The CUSTOMER has the right to access the site to browse it and make purchases. No other use, in particular commercial use, of the site or its content is permitted. All elements of this site, whether audio or visual, and the technology used remain the property of BLACK SQUIRREL PARACORD and are protected by intellectual property law.<\/span><\/p>\n

Cookies are electronic files that record information about the CUSTOMER’s browsing on the site (pages viewed, date and time of the visit, etc.) and allow BLACK SQUIRREL PARACORD to offer its customers a personalised service.<\/span><\/p>\n

BLACK SQUIRREL PARACORD informs the Customer that these files can be disabled through their internet settings menu. It is understood that doing so will prevent the Customer from making purchases online.<\/p>\n<\/div>\n<\/div>\n<\/div>\n

ARTICLE 14 – ENTIRE AGREEMENT<\/b><\/div>\n<\/div>\n<\/div>\n

These General Terms of Sale consist of all the clauses that make them up. If one or more provisions of these General Terms of Sale is considered invalid or declared so under law or regulation, or following a decision by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.<\/span><\/p>\n

Any dispute not settled amicably will be subject to the exclusive jurisdiction of the Court of the place where the CUSTOMER resides or is domiciled, if located within the territory of the Italian State.<\/p>\n
